Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the Travelers Tour Guide website and services (the “Service”), operated by Travelers Tour Guide (“we”, “us”, or “our”). By creating an account or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Travelers Tour Guide is an online marketplace that allows independent tour and activity suppliers (“Suppliers”) to list activities, and allows travellers (“Members”) to discover and book those activities. We facilitate the connection and, where applicable, the payment between Members and Suppliers, but we are not a party to, and do not guarantee, any activity or booking itself. Activities are provided by Suppliers, who are solely responsible for their content, accuracy, delivery, and safety.

• You must be at least 18 years old to create an account or make a booking.
• You must provide accurate, current, and complete information when registering, and keep it up to date.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• You must notify us promptly of any unauthorized use of your account or any other security breach.
• We may suspend or terminate accounts that provide false information or violate these Terms.

Members may browse activities, save favorites, and make bookings. Members are responsible for reviewing activity details, requirements, and cancellation policies before booking.

Suppliers may apply for supplier access to list and manage activities. Approval is at our discretion and may require identity or business verification. Suppliers are responsible for the accuracy of their listings (including pricing, availability, inclusions, and fitness or accessibility requirements), for honoring confirmed bookings, and for complying with all applicable laws, licensing, permit, and insurance requirements for the activities they offer.

• Prices are set by Suppliers and displayed in the currency you select; displayed amounts in non-default currencies are approximate and converted at rates that may differ slightly from your payment provider’s rate.
• A booking is only confirmed once you receive a confirmation from us; adding an activity to a cart or wishlist does not guarantee availability.
• Payments are processed through our third-party payment processor. By booking, you authorize us to charge the applicable amount, including any applicable service fees and taxes, to your chosen payment method.
• We may charge a service fee on bookings, which will be disclosed before you confirm payment.

Cancellation and refund terms are set by the individual Supplier for each activity and are displayed on the activity listing prior to booking. Refunds, where applicable, are processed back to your original payment method and may take several business days to appear. We are not responsible for a Supplier’s failure to honor its stated cancellation policy, but we will make reasonable efforts to help resolve disputes brought to our attention.

When using the Service, you agree not to:

• Violate any applicable law or regulation, or the rights of any third party.
• Post false, misleading, defamatory, or fraudulent listings, reviews, or content.
• Attempt to circumvent the platform to transact directly with a Member or Supplier to avoid applicable fees.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service, other accounts, or our systems.
• Use automated means (scraping, bots) to access or collect data from the Service without our written permission.
• Upload content that infringes intellectual property rights or contains malicious code.

Any reviews, photos, or other content you submit (“User Content”) must be honest, accurate, and based on your own experience. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute it in connection with operating and promoting the Service. We may remove User Content that violates these Terms at our discretion.

The Service, including its design, text, graphics, logos, and underlying software, is owned by Travelers Tour Guide or its licensors and is protected by intellectual property laws. Except for the limited license needed to use the Service, no rights are granted to you in our intellectual property. Supplier listing content remains owned by the respective Supplier, subject to the license needed for us to display it on the platform.

The Service may integrate with or link to third-party services, such as sign-in providers and payment processors. We are not responsible for the content, policies, or practices of any third party, and your use of third-party services is subject to their own terms.

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied. We do not warrant that activities listed by Suppliers will be safe, suitable, or accurate, and we are not responsible for the acts or omissions of any Supplier or other user.

To the fullest extent permitted by law, Travelers Tour Guide will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising from your use of the Service or any activity booked through it. Our total liability for any claim arising from the Service is limited to the amount of fees you paid to us for the booking giving rise to the claim, if any.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

You agree to indemnify and hold harmless Travelers Tour Guide, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms, your use of the Service, or, if you are a Supplier, the activities you list or provide.

You may stop using the Service and close your account at any time. We may suspend or terminate your access to the Service, with or without notice, if we believe you have violated these Terms, engaged in fraudulent or harmful conduct, or for any other reason at our discretion. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will continue to apply.

These Terms are governed by the laws of Sri Lanka, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will first be addressed through good-faith negotiation between the parties; if unresolved, it will be subject to the exclusive jurisdiction of the courts of Sri Lanka, except where local consumer protection law requires otherwise.

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on this page with a new “Last updated” date and, where appropriate, via email or an in-app notice. Continuing to use the Service after changes take effect constitutes acceptance of the revised Terms.
